ACCEPTANCE OF TERMS
By accessing thekubair.com, placing an order, requesting a quote, booking a service, making payment, or communicating with Kubair through WhatsApp, email, social media, or another channel, you agree to these Terms and Conditions and the policies linked on our website. If you do not agree, please do not use the website or place an order.
ABOUT KUBAIR
Kubair is the brand of Kubair Gems & Numerology, founded by Nikhil Bansal. Kubair offers crystal and Rudraksha jewellery, quote-led certified Navratna gemstones, intention kits, readings, healing services, numerology, reports, and related guidance. Kubair's products and services are intended for spiritual, reflective, devotional, emotional, and lifestyle support. They are not substitutes for medical, legal, financial, psychological, psychiatric, emergency, or other professional advice.
ELIGIBILITY
You must be legally capable of entering into a contract to place an order. If you are under 18, a parent or lawful guardian should place the order or approve the service request on your behalf.
PRODUCT CATEGORIES
Fixed-price physical products: crystal bracelets, selected Rudraksha products, Japa malas, kanthis, necklaces, intention kits, and other fixed-price spiritual products.
Quote-led products: certified gemstones, high-value gemstones, per-carat or per-ratti gemstone orders, custom spiritual jewellery, and products requiring sourcing, quality confirmation, certification confirmation, sizing, energizing, or suitability review.
Digital or service products: Tarot readings, Akashic readings and healing, Mahakali healing, Aura Scan, Chakra healing services, Reiki healing services, 7-Day Money Clearing Program, Relationship Healing, Numerology services, Lucky Gemstone Finder report, and other insight reports.
PRODUCT INFORMATION AND NATURAL VARIATION
Kubair tries to display product names, prices, descriptions, photos, certification status, care instructions, and spiritual associations accurately. Natural stones, crystals, Rudraksha, pearls, malas, beads, and handcrafted spiritual products can vary in color, shade, markings, inclusions, polish, clarity, size, shape, weight, surface texture, mukhi visibility, and finish. These variations are part of natural and handmade products and are not defects unless the product is damaged, wrongly supplied, or materially different from the confirmed order. Product photos may vary slightly from the actual product because of lighting, screen settings, natural variation, and batch differences.
CERTIFICATION AND AUTHENTICITY
Where a product is described as certified, Kubair will provide certification or authenticity details as stated on the product page, quote confirmation, or order communication. Certification terms may differ by category. Crystal jewellery is not sold as lab-certified unless a certificate actually ships with that item. Customers should review the product page and final quote confirmation carefully before payment.
SPIRITUAL ASSOCIATIONS AND CLAIMS
Descriptions of stones, Rudraksha, malas, bracelets, remedies, readings, healings, or spiritual services are based on traditional beliefs, spiritual practice, astrology, numerology, energy work, and individual interpretation. They are traditionally regarded as, or worn for, those associations. Kubair does not guarantee health, medical, relationship, career, legal, financial, psychological, spiritual transformation, or specific-timing outcomes. Your actions, choices, circumstances, professional advice, and personal responsibility remain important. Kubair products and services are not a replacement for effort, personal responsibility, or professional advice.
QUOTES AND GEMSTONE ORDERS
Certified gemstones are quote-led. There is no sourcing fee.
The path is: you request a quote; Kubair presents a stone; you approve the stone; Kubair issues an invoice; after prepaid payment, Kubair sources and ships. A quote-led product is not final until you approve the stone and pay the invoice. Website prices may be indicative, per-carat, per-ratti, starting price, or placeholder pricing.
If you have purchased a Lucky Gemstone Finder report (₹399), that amount is fully credited toward that gemstone order when you request a quote and quote the report order number.
Kubair may decline or revise a quote if stock, quality, market rate, certification, supplier availability, or customer requirements change before you approve the stone and pay the invoice.
ORDERS AND ACCEPTANCE
An order is accepted only when Kubair confirms it and prepaid payment is received or verified. Kubair may cancel or refuse an order if the product is unavailable, the price was incorrect due to error, payment is not received or cannot be verified, the order appears fraudulent or abusive, the delivery address is incomplete or unserviceable, the product is quote-led and the stone has not been approved and invoiced, or the request is outside Kubair's scope or violates these terms. If payment has been received for an order Kubair cannot fulfill, Kubair will first offer a suitable replacement, corrected order, alternate product, store credit, or revised quote. A refund is used where Kubair cannot provide a reasonable replacement or correction, or where required by applicable law, including the Consumer Protection Act 2019.
PAYMENT TERMS
All orders are prepaid. Cash on delivery (COD) is not available. Partial COD is not offered.
Payment may be collected through Shopify checkout, a payment gateway, payment link, UPI, QR code, bank transfer, or another prepaid method shared by Kubair on official channels. Customer-facing payment instructions must come only from Kubair's official website, official email, official WhatsApp number +91 8004455881, or a verified checkout or payment provider. For manual payments, orders may remain pending until Kubair verifies the payment.
PRICING, TAXES, AND ERRORS
All prices are listed in INR unless stated otherwise. Listed prices are GST-inclusive — the rupee amount shown is what you pay. Kubair Gems & Numerology is registered under GST. GSTIN: 09ENYPB7031P1Z5. Applicable GST will be charged and shown as required. Shipping within India is free. Kubair may correct pricing, stock, product, or typographical errors. If an error affects a confirmed order, Kubair will contact the customer and provide a reasonable resolution.
SHIPPING
Shipping is governed by Kubair's Shipping Policy. Kubair ships physical products within India only. International shipping is not offered. Digital services, online sessions, readings, healings, and reports do not require physical shipping.
CANCELLATIONS
Prepaid physical product orders may be cancelled before dispatch if the order has not been packed, customized, sourced, resized, energized, or otherwise prepared specifically for the customer. If that cancellation is approved, amounts paid for the unprepared item will be refunded.
Quote-led gemstone orders may be cancelled before you approve the stone and pay the invoice. After you approve the stone and pay the invoice, cancellation is not available once sourcing or special preparation has started.
Paid services, readings, healing sessions, reports, and spiritual work may be cancelled or rescheduled only according to the service cancellation terms shown on the service page. Once preparation, booking, or delivery has started, the service may be final-sale.
SERVICES, READINGS, HEALING SESSIONS, AND REPORTS
When you purchase a spiritual service, you agree that the service is spiritual, reflective, and guidance-led; you are responsible for providing accurate details required for the service; delays may occur if required details are incomplete or unclear; delivery format may include voice call, written note, voice note, report, WhatsApp guidance, scheduled session, or another format stated on the service page; no specific personal, emotional, medical, legal, financial, relationship, career, or spiritual result is guaranteed; and services are not emergency services and should not be used in crisis situations.
INDEPENDENT PRACTITIONER SERVICES
Some services may be delivered by Dr. Mmalvikaa, an independent practitioner. Kubair lists the service, takes the booking and payment, collects intake, packages branded deliverables, and handles customer support. The practitioner delivers the spiritual service content. The practitioner does not message the customer. Kubair owns intake, branded PDF deliverables, and customer support. A written collaboration agreement between Kubair and the practitioner governs the scope, responsibilities, data handling, and commercial terms. Kubair does not guarantee the practitioner's spiritual interpretation, personal advice, energetic outcome, or the customer's individual result.
CUSTOMER RESPONSIBILITIES
You agree to provide accurate contact, payment, shipping, and service intake details; review product descriptions, quote terms, service details, timelines, and policies before payment; use products safely and as instructed; keep products away from water, perfume, chemicals, rough handling, and unsafe storage where relevant; seek qualified professional help for medical, legal, financial, psychological, psychiatric, or emergency matters; and not misuse Kubair's website, forms, WhatsApp support, or payment channels.
INTELLECTUAL PROPERTY
All Kubair names, logos, product descriptions, website content, photos, graphics, policies, product structures, and brand materials belong to Kubair Gems & Numerology or its licensors unless otherwise stated. You may not copy, reproduce, publish, scrape, modify, resell, or commercially use Kubair content without written permission.
PROHIBITED USES
You may not use Kubair's website or services for unlawful activity; to harass, abuse, threaten, impersonate, or defraud any person; to submit false, misleading, or fraudulent information; to interfere with website security or operations; to scrape, spam, reverse engineer, or misuse website systems; to resell products or services in a misleading manner; or to make false claims about Kubair products, certification, practitioner services, or spiritual outcomes.
LIMITATION OF LIABILITY
To the extent permitted by applicable law, Kubair will not be liable for indirect, incidental, special, consequential, emotional, spiritual, financial, reputational, or personal losses arising from use of the website, products, readings, healings, reports, guidance, or third-party services. Nothing in these Terms limits liability that cannot be limited under applicable law, including rights available to consumers under the Consumer Protection Act 2019.
GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of India. Kubair will first try to resolve customer issues through support at admin@thekubair.com or +91 8004455881. Subject to rights available under consumer protection laws, disputes will be handled by competent courts, consumer forums, or authorities having jurisdiction under applicable law, with Lucknow, Uttar Pradesh as the contractual forum.
CHANGES TO TERMS
Kubair may update these Terms from time to time. Updated terms will be posted on the website with a revised "Last updated" date.
